This session discusses the remedies available to a dominant landholder where a servient landowner obstructs or interferes with an easement, the circumstances and evidence required to make such remedies worth pursuing, and when to fight or surrender. It covers:

  • Self-help remedies available to a benefitting landowner
  • Claims for damages arising from an obstruction of an easement
  • Available equitable remedies and important factors to consider
  • Valuation of easements in compulsory acquisition of land disputes

Lee-Ann Walsh

Called to the bar in 2012, Lee-Ann has developed a diverse range of practice areas with a strong focus on real property and commercial law. She provides advice across a range of areas, appears in interlocutory and first instance hearings, as well as mediations and conciliation conferences. Since coming to the bar, Lee-Ann has also been led in the High Court in key property and commercial cases.

Lee-Ann is a frequent speaker at professional education events and is an adjunct lecturer at the College of Law. She is also the Editor of Hallmann’s Legal Aspects of Boundary Surveying.

Prior to being called to the bar, Lee-Ann worked in the legal publishing and policy fields and as an Associate in the NSW Court of Appeal.

Lee-Ann accepts briefs in all Australian jurisdictions.
