About the Webinar

Estate planning isn’t just about who gets what — it’s also about how assets are held after death. Placing different asset classes into the most appropriate structure can have far-reaching tax, control, and succession implications. Intermingling assets in a single testamentary trust may seem simple but can cause unintended problems, particularly where different beneficiaries or asset types are involved. This session examines the importance of aligning assets with the right trust strategy. It covers:

  • Whether the CGT main residence exemption can continue when the home passes to a testamentary trust
  • Taxing superannuation death benefits: risks of mixing tax and non-tax dependants in the same trust
  • The risks of combining assets in one testamentary trust where family relationships are strained
  • How to allocate assets of equal value between separate trusts — managing unrealised capital gains
  • Planning for potential land tax exposure when trusts are used as ownership vehicles
  • The best structure for passing on property used in a family business
  • Where life estate property sits — does it remain in the estate or pass to a trust?
  • Practical problems that arise when multiple asset classes are combined in a single testamentary trust
