Ambiguity in wills is nothing new, particularly in documents drafted decades ago or before major changes in family circumstances. Disputes often arise over whether the will truly reflects the testator’s intentions or simply what the words on the page convey. Too often, well-meaning practitioners “fill in the gaps” based on what they think the will should have said, rather than applying the proper rules of construction. This session explores how to navigate these tricky situations and avoid costly or absurd outcomes, including:

  • Applying the established principles of will construction to de-identified, real-world examples from practice
  • Recognising the consequences of poor or incomplete drafting, illustrated through notable cases and cautionary examples
  • Using precedent clauses safely, including terms to avoid, matters to clarify, and steps to verify instructions and asset ownership
  • Knowing when and how to brief Counsel for advice on interpreting the will and related documents
  • Identifying and gathering relevant extrinsic evidence to clarify testamentary intent without overstepping the limits imposed by the law
  • Managing disputes over will construction strategically, including negotiation approaches and when to proceed to court for directions

Angela Cornford-Scott is the director of Cornford-Scott Lawyers Pty Ltd and an accredited specialist in succession law. She has worked in the area of succession law for over 25 years and has a particular interest in estate planning, trust matters and estate administration issues.

Angela is a current member and past Chair of the QLS Succession Law Committee. Angela is a member of STEP and a previous Chair of the Queensland Branch. She has lectured for QUT, the College of Law and is a regular presenter of seminars. She also co-authors the Lexis Nexis practical guidance publications in Succession law and Elder law for Queensland. She was awarded the STEP Australia Masters Award in 2025. Angela has been named in the Doyles Guide as the market leader in the areas of both Wills and Estates and Estate Litigation in Queensland and was the only Queensland lawyer named as pre eminent in both categories in the years from 2018 to 2025 Doyles Guide Australia. Angela was also named the Lawyer of the Year for 2020, 2022, 2025 and 2026 in Succession Planning by Best Lawyers.
