This session examines the common, and not-so-common mistakes practitioners make when navigating PPS issues for their clients, including:
- What categories of agricultural assets can be used as security?
- Relationship between security interests in crops and interests in land – section 84
- Crops and livestock as personal property – sections 84A, 85 and 86 PPSA
- Registration of a security interest the technical requirements and the consequences of not having a valid registration
- Retention of title clause in sale and purchase contracts – their importance in the PPS context
- Priority of security interests and the effect on competing claims
- The length of protection of registration – renewing registration before expiration
- Consequences of failure to check the register on a purchaser of land or assets
