It was unlikely to have been in contemplation at the time the Family Law Act was drafted that it would one day need to deal with cryptocurrency, non-fungible tokens and other digital assets. It is now estimated that approximately five million Australians own cryptocurrency with that number on the rise. Digital assets are therefore not only here to stay but will become more common in family law over the next few decades. To help family lawyers understand digital assets and ask the right questions to ensure their existence in a matter is uncovered and can be disclosed and dealt with by the Court, this session will explore:

  • Different types of digital assets - what they are and how they work, including crypto wallets, staking, and smart contracts
  • DeFi (decentralised finance) - how it operates, what to do if digital assets are locked up in a DeFi process and when to seek specialist advice (and from who)
  • What questions to ask of your client or the other party to identify digital assets
  • How digital assets are valued and evidentiary issues and limitations
  • Tips for how to deal with digital assets including how to frame orders and dealing with liquidity issues and fluctuating value of digital assets

Fraser is a Partner in the HopgoodGanim Lawyers Family and Relationship Law practice based in the Brisbane office.

Fraser’s practice encompasses all types of family law matters including complex financial disputes (particularly those that involve significant asset pools, a large number of companies and trusts or complicated valuation issues); financial agreements (both pre and post nuptial and for de facto couples); spousal maintenance disputes; and parenting and child support matters.

While he practices from Brisbane, Fraser has appeared in various other states and regularly advises clients residing outside of Australia. Fraser is also a regular contributor to legal commentary on topical issues in family law.

Fraser holds a Bachelor’s degree in Laws and Commerce from the University of Queensland and Master’s degree in Applied Law (Family Law) from the College of Law. He began practicing as a solicitor in 2011 and has practiced exclusively in family law since 2014. He is admitted to the Supreme Court of Queensland and the High Court of Australia.

Fraser was ranked by Doyle's Guide as Family Law Rising Star – Queensland (2020) and Brisbane (2021).

Fraser sits on the Queensland Rugby League Judiciary and Disciplinary Tribunals as a panel member.
