Property disputes can entangle more than the divorcing couple. Parents who have lent money to a child who is now facing divorce may end up being exposed. This session looks at ways in which you can protect third parties in circumstances where they are assisting their child. The court has the power to make orders in relation to third parties but there may be things you can do now to protect your clients’ interests. This session covers:

  • Gift vs loan – understanding the difference in property disputes
  • Mortgage documents and registering a proper interest – getting the documents in order
  • Making sure the spouse understands the arrangement – the benefits of transparency
  • When can the court exercise its accrued jurisdiction? Contractual, partnership and shareholder disputes
  • Orders under the Family Law Act to alter the rights, liabilities or property interests of third parties affected by the dispute – when will they be made?

Adam Cooper

Adam Cooper has been a family lawyer and advocate for over 20 years. He initially started practice as a barrister, before taking on special counsel roles and then establishing Cooper Family Law in 2011. Prior to becoming a lawyer, Adam was a professional footballer and counsellor.

Adam is considered around Australia as a thought-leader in family law, regularly speaking at family law conferences. He has delivered papers on technical property settlement matters, family violence, substance abuse, family law court advocacy and other key areas. He is the author of the Domestic Violence component of the Queensland Law Handbook and regularly appears in radio broadcasts discussing family law matters.

Adam’s has clients throughout Australia and overseas. He regularly appears in both state and federal courts, and has advised judges in matrimonial courts of the United States about the family law of Australia.

Adam also has tertiary qualifications in social science and has a deep understanding of the difficulties faced by family law clients, and the need to pursue timely resolutions.
