This session provides a practical overview of the main tax issues that arise when transferring a family business within the family or selling to an external party. It will outline the key concepts advisers should be aware of when helping clients choose between succession and exit options, including:

  • How tax rules can affect transfers of equity to family members
  • Considerations when selling shares or business assets to non-related parties
  • Approaches to extracting sale proceeds from a company in a tax-effective manner
  • Structuring issues when the business is operated through a discretionary trust or held via a trust structure
  • Common traps involving control changes in entities that own land or other significant assets
