Minimising potential family provision claims arising after the death of the testator is a primary driver of many estate planning strategies. One option that may be available is to bring forward an inheritance by transferring assets and/or farming operations over to the next generation during the testator’s lifetime. To help estate planners consider inter vivos transfers more comprehensively, this session explores:

  • The circumstances in which it may be beneficial to transfer during a lifetime and the advice that needs to be provided to clients
  • The relevant duty exemptions and flag how the law and approach differs as between states (e.g. provisions in NSW to contract out of family provision claims vs requirement to actually transfer property in other states)
  • Options for protecting assets once it is in the hands of adult children
  • Tips for documenting agreements to protect against family provision claims being made in the future
