A superannuation split may occur under either a splitting order or a superannuation agreement, which forms part of a financial agreement. However, super splits need to be carefully adapted to best suit your client’s circumstances. This session examines the following:
- What is a splittable payment?
- Should the splittable payment be a dollar figure or a percentage?
- What is the operative date?
- What is the most appropriate splitting method? Order or agreement?
- Factors to consider:
- Transfer balance account issues
- Tax consequences including CGT and whether any CGT rollover relief should be claimed
- Other issues with SMSFs
- Implementing a split
