It is a common for a testator to name multiple executors in their will. While this may sound like a good idea at the time, it can result in significant conflict, litigation, costs and stress for the family (and the lawyer) if executors conflict. This session will examine:

  • The duties and responsibilities of executors and the unique issues that can arise when there are multiple executors;
  • Options for dealing with conflict between multiple executors and strategies for identifying and preventing conflict:
    • Passing over applications
    • In what circumstances a judge may consider it appropriate to remove an executor
  • Practical insights into when it may be appropriate to apply pressure and/or involve the Court when faced with a difficult or non-responsive executor/s
  • Lessons from recent cases
