For property lawyers, knowing when and why a court will imply a term is critical, both to protect clients in disputes and to draft contracts that minimise risk. This session distils the key decisions and draws out their practical lessons for property transactions. It covers:

  • Recent appellate decisions on implied terms and their reasoning
  • What factual circumstances persuaded courts to imply obligations, and what duties followed
  • Broader implications for parties — and how disputes might have been avoided
  • Practical refresher: construing contracts and identifying relevant context
