The preparation of a settlement deed or checklist in advance means you can take control of the negotiations with your own document, ensuring a quick resolution with all the bases covered. This session will set out the key elements of settlement arrangements in the estate litigation context, including:

  • Accurate naming and details of parties and any relevant third parties
  • Framing recitals and non-admission of liability
  • Defining the dispute – what is the deed settling?
  • Describing relevant property and other assets to be paid, transferred or provided and the responsibility for associated taxes or duties
  • Next steps – both interim and long term
  • Relevant warranties and indemnities
  • Releasing the parties and any third parties
  • Liability for legal costs
  • Confidentiality and non-disparagement obligations
  • Obtaining independent legal advice

Asheetha was admitted to practice in 2003. She has over 20 years' experience in Wills and Estates Law and became an Accredited Specialist in 2011. She is appointed by the Law Society of NSW as a member of the Advisory Committee for Specialist Accreditation in Wills and Estates, as is the Head Assessor of that committee. She is also the Chair of the inaugural Advisory Committee for Special Accreditation in Elder Law in NSW.

Although her main area of practice is in contested estate litigation, including testamentary capacity matters, family provision cases and other trust and estate administration suits, she has utilised that experience in her growing estate planning practice. Asheetha has been appointed as a Court Appointed Administrator for estates.

She is a regular presenter at seminars and workshops in the areas of Wills and Estates law. Asheetha is a member of the Society of Trust and Estate Practitioners. Asheetha is listed in the 2025 Doyles Guide’s lists as a Preeminent Wills & Estates Litigation Lawyer and Wills, Estates & Succession Planning Lawyer in NSW.
