About the Webinar

Like any long-standing structure, trust deeds sometimes need a refresh to keep pace with evolving family, business, or regulatory needs. But amending a deed isn't always straightforward — and a well-intentioned change can unintentionally trigger significant tax consequences. This session explores the practical, legal, and tax issues that can arise when modernising a trust deed, including:

  • Common triggers for amending the trust deed
  • The process to be followed when amending a trust deed
  • Trust deed amendments that can trigger tax consequences and those that don't
  • Can an amendment to a trust deed be tax effectively made to:
    • extend a vesting date that had unknowingly passed?
    • extend an original vesting date yet to be reached, to a later date?
  • Can a trust deed amendment:
    • impact on a trust’s carried forward tax losses?
    • trigger tax issues if being undertaken to cater for adding beneficiaries due to a new blended family arrangement?
  • Can tax issues arise if an original copy of the trust deed can't be located?
  • A checklist of the processes to follow, questions to ask and documentation to maintain, when considering a trust deed amendment
  • Practical examples of tax effective and ineffective trust deed amendments
