It’s not uncommon for relationship breakdown to occur later in life. This, coupled with extensive court delays, can mean death is an issue in a party’s family law matter. What is the effect of death, and imminent death, on the property aspects of matrimonial and de facto relationship breakdown under the Family Law Act? This session provides the answers. It covers:

  • Impact of death of a party before property proceedings are commenced

  • Continuation of property proceedings after the death of one party

  • Substituting the LPR of the deceased party as a party to the proceedings

  • What if the surviving spouse is the executor of the deceased party’s estate?

  • Death of both parties in the proceeding

  • Property of the parties – how does this change as a result of death of one of them?

  • What if the surviving spouse’s financial circumstances improve as a result of the other party’s death?

  • Imminent death of a party – how will the Court apply section 75(2) factors?

Cathie Blanchfield has practised exclusively in family law and related areas since admission over 35 years ago. Prior to establishing Blanchfield Nicholls with Nigel Nicholls in 2007, she was a partner with Stuart Fowler until his judicial appointment.

Cathie has been named as a leading family lawyer in the Doyles Guide every year since 2016, including in High Value and Complex Property Matters.

Over the years Cathie’s work has focused primarily on financial and property matters for married, de-facto and same sex couples. She regularly advises in matters involving complex financial arrangements. She enjoys the challenges inherent in communicating sometimes difficult concepts in family law, and working to understand each client's particular needs and expectations while giving realistic advice.

Cathie has developed and maintains a particular interest and expertise in financial agreements under the Family Law Act such that drafting and advising in such matters is a significant part of her day to day practice. Each is as different as each client’s particular needs and reasons for making an agreement, making it an always interesting and challenging area.
