Much of the discussion around AI risk has focused on how lawyers themselves should use AI responsibly. But a growing and less explored risk arises from how clients are using AI tools in connection with their legal matters. Clients are increasingly using AI to interpret legal advice, summarise communications, draft documents and prepare submissions. When these tools are used incorrectly, the consequences can include waiver of privilege, breaches of court undertakings, evidentiary issues and misunderstandings of legal advice. This session explores the professional risks that can arise when clients rely on AI and the steps firms can take to manage those risks. It covers:
- Common ways clients are currently using AI tools in connection with legal services, including interpreting legal advice, drafting documents and preparing communications
- The legal and evidentiary risks that may arise, including waiver of legal professional privilege, breaches of undertakings such as the Harman obligation, and credibility issues with AI-generated material
- The potential professional liability exposure for firms when client misuse of AI affects the conduct of a matter
- Practical strategies to manage these risks, including retainer drafting, scoping of work, client communication protocols and clear policies regarding AI use in client matters
