All succession lawyers must know how to properly draft a will that meets the needs of your client and minimises future risks. However, will-making is becoming increasingly difficult, with rapidly changing family dynamics, tax considerations and increased risks of family provision claims. This session assumes you know the will drafting essentials, and instead focuses on some of the more difficult drafting issues that can arise. It covers:

  • Making sure the beneficiaries are correctly defined
  • Drafting the appointment of executors
  • Drafting exclusion clauses to leave beneficiaries out
  • Drafting to avoid income tax, CGT, and duty pitfalls
  • Drafting to minimise exposure to family law and bankruptcy claims on beneficiaries
  • Drafting to preserve means tested pension entitlements for beneficiaries
  • Drafting options for blended families (mutual wills, life interests and rights of occupation)
