About the Webinar

As the next generation moves away from the land, the traditional intergenerational transfer of the family farm is becoming less common — and with that change comes complex stamp duty implications. Whether the farm is passed down, restructured, or sold to an unrelated party, understanding the applicable exemptions, concessions and traps is critical. This session unpacks the duty consequences across a range of real-world scenarios, including:

  • How stamp duty applies to the sale or transfer of the family farm
  • The available duty exemptions and concessions for the family farm
  • Does the structure the family farm is held in, or will be held in, on a sale or transfer impact on the stamp duty treatment?
  • Does having a main residence on the land impact on the duty consequences on a transfer or sale?
  • Stamp duty pros and cons of selling or transferring the family farm pre or post death of the matriarch or patriarch
  • Situations where the exemption to duty on sales or transfers of the family farm are being denied in practice
  • Stamp duty issues to consider:
    • for restructures involving the family farm for asset protection purposes
    • when the farming business has ceased at the time of selling or transferring the land
    • for estate planning involving the family farm
  • How the stamp duty rules for the family farm vary between the states and territories
