Does a successor trustee owe fiduciary duties to a former trustee in relation to the former trustee’s right of indemnity from trust assets? This long-debated question has finally received a clear answer from the High Court in its landmark decision in Naaman v Jaken Properties Australia Pty Ltd [2025] HCA 1. While the ruling settles the legal question, the practical implications for trustee succession are far from straightforward. This session examines:

Paige regularly assists clients with the design and implementation of family constitutions, advisory boards, bespoke trust deeds and company constitutions, as well as restructuring entities to support long-term succession goals. She also facilitates family meetings and works closely with accountants, financial advisors, and other professionals to provide integrated solutions.

Paige has a particular interest in trust law, including charitable trusts, superannuation funds and family trusts. She advises trustees on the discharge of their obligations and frequently acts in applications to the Court for directions, rectification of trust deeds, or reconstruction of lost deeds.

Paige attained a Bachelor of Laws (Corporate and Commercial Law Specialisation) from Bond University and a Master of Taxation (Tax Law) from the University of New South Wales.
