Easements are often the subject of demand by clients, whether it be a client seeking one or a client seeking advice when they are adversely affected by one. Regardless of which side you are acting for, it is important to consider all the relevant aspects of the law when it comes to easements before proceedings are commenced. This session shall:

  • Examine the types of easements and their variation/extinguishment
  • Discuss issues arising from more complicated types of easements, including compulsory easements, those limited in stratum, cross-easements, water flowing over land/drainage, over a track in use, burial grounds, community schemes, Crown land
  • Guide practitioners through the making an application for an easement on Crown Land - what extra steps do you have to take when dealing with Crown reserve land (e.g. native title considerations, terms for easements etc)
  • Explore the impact of easements on property valuation, section 88K instruments and takeaway lessons from recent cases in the Land and Environment Court
  • Consider the practicalities of giving advice about easements and related interests - what level and detail of investigation to be able to give legal advice about whether a right of way can be extinguished or maintained

Lee-Ann Walsh

Called to the bar in 2012, Lee-Ann has developed a diverse range of practice areas with a strong focus on real property and commercial law. She provides advice across a range of areas, appears in interlocutory and first instance hearings, as well as mediations and conciliation conferences. Since coming to the bar, Lee-Ann has also been led in the High Court in key property and commercial cases.

Lee-Ann is a frequent speaker at professional education events and is an adjunct lecturer at the College of Law. She is also the Editor of Hallmann’s Legal Aspects of Boundary Surveying.

Prior to being called to the bar, Lee-Ann worked in the legal publishing and policy fields and as an Associate in the NSW Court of Appeal.

Lee-Ann accepts briefs in all Australian jurisdictions.
