Easements can turn routine Queensland property matters into expensive disputes, particularly where access, services or future development rights are at stake. From shared driveways and drainage infrastructure to unclear historic easements and changing land use, practitioners need to understand both the scope of the rights granted and the limits on how they can be exercised. This session examines the practical issues that arise when easements become contested, including:

  • Implied easements and why they remain difficult in Queensland’s Torrens title system
  • Drafting easement terms that clearly define the land affected, the rights granted and any limits on use
  • Scope disputes, including overuse, intensification and changed use of the dominant land
  • Access, drainage, stormwater and utility easements, including maintenance and repair obligations
  • When easements can be modified or extinguished under the Property Law Act 1974 (Qld)
  • Practical lessons from recent Queensland easement disputes and how to reduce future conflict
