While it is too late to prevent litigation once it has commenced, there are many practical strategies estate planners can employ to prevent or reduce the risk of legal challenges and claims made against the estate after death. This practical session examines the following:

  • The types of claims that could arise, what to look out for to anticipate claims before death and how to identify matters at risk of litigation once testator dies
  • Practical case studies examining the advantages of restructuring before death and other strategies (both formal and practical) to prevent prospect of litigation in first place
  • The role of disclosure, how to plan for and implement effective family meetings to explain the reasons behind the estate plan
  • Tips for adding value to your client - understanding your client’s motivations, establishing rapport and trust with your client, and developing strategies for matching the estate plan to the family dynamic

Greg Russo has almost 30 years’ experience in succession planning, administration and litigation and is one of Victoria’s most experienced and respected succession law solicitors.
