As clients increasingly provide financial assistance to family members during their lifetime - whether through loans, advances, or informal support - estate planning practitioners must tread carefully. The legal and tax consequences of mischaracterised transactions can ripple through an estate, triggering disputes, tax liabilities, and challenges to the intended distribution. This practical and session will equip succession lawyers with strategies to manage these risks, including:

  • How to deal with inter-entity loans in estate planning - including implications of Commissioner of Taxation v Bendel [2025] FCAFC 15 on Division 7A, unpaid present entitlements (UPEs), and structuring considerations for trusts and companies
  • Navigating disputes over whether financial assistance was a gift or a loan - including evidentiary challenges, the impact on the estate’s asset pool, and broader implications for social security, aged care assessments, and equitable distribution
  • Structuring techniques to reduce uncertainty - such as documentation best practices, equalisation clauses, acknowledgement of debts, and alternative approaches to intra-family financial arrangements
