While costs generally follow the event, it often goes without saying that the cost component of any litigated matter should be proportionate to the substantive proceedings. However, in some cases that sense of proportion is lost, leaving the solicitors involved at the risk of personal costs orders, and possibly complaints made, against them. This session shall provide an overview of costs in commercial litigation proceedings and discuss:

  • The rules governing the recovery of litigation costs in state and federal court commercial litigation matters
  • The reasons why matters can get out of hand (how to spot these early and steps to take to prevent cost orders being made against you or your client);
  • The factors which need to be weighed up when considering whether and how to cost orders against third (or non) parties to proceedings; and
  • The lessons for practitioners in what not to do following the seminal decision of Dixon J in Banksia Securities and other cases of note

Geoffrey Adelstein

Geoffrey Adelstein is Principal of Adelstein Solicitors of Sydney. He has been practising as a Lawyer for over 45 years and is an Accredited Specialist in Advocacy and Personal Injury.

In his long career, he has practised extensively in personal injury litigation, having acted for injured persons and Insurers. He has been a Supreme and District Court Arbitrator, a CARS Assessor and Workers Compensation Arbitrator.

In more recent times he completed his Masters in Commercial Litigation. He practises extensively in commercial and insurance litigation and appears regularly as an advocate, across jurisdictions. As a passionate advocate, Geoffrey regularly presents workshops and trainings in advocacy to the profession, when he is not appearing in Court or instructing.

Geoffrey is Special Counsel to Elmassian Lawyers and provides consultant services to Thornton and King Lawyers.
