About the Webinar

In late 2023, the new laws governing unfair contract terms (UCTs) came into effect. At the time, the profession held many concerns arising from the significantly increased penalties and expanded scope of the regime. But, what has the experience of the changes been in practice? This session explores the practical issues that have arisen since implementation and the key lessons they pose for practitioners, including:

  • How UCT cases have been dealt with by the regulators and courts, including the High Court case of Karpik v Carnival
  • Developments arising from recent ASIC actions and ACCC announcements
  • How the experience of the new UCT regime has been in practice? What issues which have arisen in practice since its commencement and how are these being addressed?

Anand Shah joined the Queensland Bar over 20 years ago after practising as a solicitor for eleven years. Anand's practice areas include commercial litigation, administrative law, succession law, defamation and human rights.

Anand has appeared as counsel in the High Court of Australia, the Queensland Court of Appeal, the Federal Court of Australia and as trial counsel in all Queensland State Courts, the Federal Circuit and Family Court of Australia and many Tribunals. Anand has acted as a mediator in a variety of disputes including succession, personal injuries, commercial, and professional negligence.

Anand has been elected by the Queensland Bar, on many occasions, to serve on its Bar Council (the Bar's peak executive body). Anand has presented at legal conferences for over 20 years and has written for LexisNexis over a similar period.

Anand is a past President of the Asian Australian Lawyers Association (AALA) (Qld Branch). AALA's main aim is to promote cultural diversity in the legal profession.

Some of Anand's spare time is made up of reading fiction, listening to the radio and vinyl records, and watching classic and arthouse movies with his wife, and enjoying the company of their pooch.
