About the Webinar

NDIS providers face unique challenges when a worker’s illness, injury or impairment affects their ability to perform their role safely. Decisions about capacity are not just employment matters — they directly impact participant safety, regulatory compliance and organisational risk. This session examines how providers can navigate these competing obligations and implement a defensible approach to managing staff capacity. It covers:

  • The intersection of disability discrimination law, Fair Work Act protections, workers’ compensation and WHS duties in a care environment
  • How to assess whether a worker can safely perform the inherent requirements of their role in the context of participant-facing services
  • Why generic position descriptions are often inadequate, and how to define role requirements in practice
  • The rules around obtaining and using medical information, including privacy and confidentiality obligations
  • The process required before concluding a worker cannot perform their role, including consideration of reasonable adjustments
  • How to balance employee rights with participant safety and NDIS Practice Standards obligations
  • Common mistakes providers make when managing ill or injured staff — and how to avoid them
