In farming families, it can be common for family members to use colloquial or pet names to refer to various assets and farming operations. While in some cases these names may refer to the origin of the asset, in other cases the reference may be to the current or the future owner of occupier of land pursuant to an alleged family understanding. Often, there is a disconnect between the understanding of the testator as to what is “theirs” and how this can be legally dealt with in an estate planning context. For estate planning lawyers, it is critical that further and proper enquiries are made to ascertain the true legal and equitable entitlements of land and assets before advice can be given and steps taken to prepare and implement an estate plan. This session shall look at:

  • How to identify what assets a testator can actually leave behind - what is theirs and what may be owned in another structure or by another entity
  • Spotlight on assets other than just land, such as stock, plant and equipment, future revenue streams, and water entitlements
  • How to identify potential claims, entitlements and liabilities against the farm, including claims from employees for unpaid wages/superannuation, WHS claims etc), outstanding tax liabilities, financing or lease arrangements
  • Impact of carbon farming and sequestration arrangements and the opportunities these may present for estate planning
