Family conflict is one of the most significant drivers of estate litigation, often transforming otherwise sound estate plans into costly and protracted disputes. For estate planners, understanding how family dynamics translate into legal risk is critical. This session focuses on the legal pressure points where family conflict commonly escalates into formal disputes, and the practical steps advisers can take at the planning stage to minimise exposure to family provision claims, trust disputes, and challenges to testamentary intentions. The session emphasises preventative legal strategies, robust drafting, and adviser decision-making aimed at reducing the likelihood of conflict before death occurs. It covers:

  • Common legal triggers that cause family conflict to escalate into estate and trust disputes
  • How family provision legislation interacts with strained family relationships and unequal treatment of beneficiaries
  • Identifying high-risk estate planning scenarios, including blended families, estrangement, informal promises, and inter vivos arrangements
  • Drafting strategies to reduce ambiguity and minimise grounds for challenge, including statements of intention and structuring choices
  • The role of trusts, testamentary discretion, and control mechanisms in managing (or exacerbating) post-death conflict

Daniela is a Principal Lawyer in Harwood Andrews' wills and estates law practice area.

Daniela’s extensive experience allows her to advise clients about the importance of proper succession planning. She assists clients in preparing wills and powers of attorney, including complex wills such as testamentary trusts.

Daniela is experienced in all aspects of estate administration. Through the personal experience of dealing with the loss of a close family member, she understands the difficulties families face during this time and approaches each client with sensitivity and careful guidance.

Her interest in corporate governance has resulted in Daniela having been a past director on the board of Barwon Health, the largest regional health service in Victoria and a current director of Meli Housing, a youth agency providing housing services disadvantaged young people in the Geelong region.
