About the Webinar

Life interests have long been used to balance competing interests in succession planning, particularly between spouses and children. But the ATO’s draft tax determination on life interests has put renewed focus on the CGT consequences that can arise when those interests are created, varied or brought to an end. What was once seen as a relatively straightforward planning tool can now trigger unexpected tax outcomes, particularly where parties seek flexibility after death. This session examines the evolving tax and legal landscape for life interests, with a focus on how the ATO’s current views impact administration, variation and drafting. It covers:

  • The ATO’s draft position on life interests and when CGT events may be triggered
  • The tax consequences of creating, surrendering or terminating a life interest — and who bears the liability
  • When a life tenant or remainderman seeks to exit early: legal pathways and tax risks
  • Whether life interests can be varied, exchanged or accelerated,  and the consent required
  • Common deficiencies in will drafting that increase the risk of adverse tax outcomes
  • How to draft life interest provisions to preserve flexibility without triggering unintended CGT consequences
  • Practical examples illustrating where life interests go wrong and how to avoid it
