Escalating builder insolvency nationally has seen carnage for all stakeholders in the property development industry. However, it appears that the most affected continue to be consumers with insufficient protection despite statutory schemes. This session will examine the situation for builders and consumers following builder insolvency, and suggest measures to move the burden further away from consumers, including:

  • When does the statutory insurance apply and what problems do consumers face in accessing it?
  • What does “disappear” mean in the context of the statutory insurance scheme?
  • Inadequacies of the insurance coverage – not just monetary
  • The impact of the ipso facto legislation on building contracts and consumers
  • Steps consumers need to be taking in the current climate to better protect themselves from the potential insolvency of their builder
  • Practical guidance for lawyers assisting impacted consumer clients

Daniel is a senior associate in our Insurance & Reinsurance team based in Melbourne.

Daniel is an experienced disputes and advisory lawyer, specialising in complex commercial, financial services litigation and professional liability (including directors' duties).

To highlight a few of those complex matters, they include 'bet the farm' litigation arising out of the (high profile) collapse of a global supply chain finance provider; multi-party construction defects dispute arising out of ground subsidence and groundwater flows; and conflicted commission claims arising from the Hayne Financial Services Inquiry.

Daniel also has extensive experience in insolvency law, having acted for both liquidators and company officers on a range of corporate and personal insolvency matters including director examinations, voidable transactions, and director duties claims (including insolvent trading).

Daniel is fluent in English, Mandarin and Indonesian.
