Since the global pandemic, the world of insolvency and debt restructuring has seemingly turned upside down (and back up again) as measures introduced by governments to assist businesses and the economy stay afloat during the uncertain times are slowly wound back. For Australian businesses, the changing landscape has resulted in more distressed companies looking to restructure to remain solvent. This session takes a closer look into the area of distressed and solvent trading and will provide:

  • An introduction to the current restructuring and insolvency market and legal framework in Australia (including schemes of arrangement and their current status and relevance)
  • An overview of the options available to companies in financial distress and the advantages and disadvantages of each
  • Guidance for assisting distressed companies undertake restructuring including overview of procedures
  • The challenges which lie ahead in this area including sustained consequences of the pandemic, rapid inflation and the Ukraine conflict

Graeme is a principal with 30 years’ experience in commercial dispute resolution, having acted in a broad range of industries in small claims to large scale litigation, including contract, intellectual property, partnership and shareholder disputes. 

Graeme's practice is primarily focussed on insolvency and restructuring related matters, advising and assisting insolvency practitioners and other stakeholders with all aspects of an appointment including security reviews, litigious claims and public examinations. 

Graeme has a keen interest in the Personal Property Securities Act 2009 (Cth) and has presented to a range of professional associations, accountants, insolvency practitioners and clients on the practical implications of the PPSA.

Graeme brings a practical approach to his practice, viewing litigation as a tool to achieving a desired outcome, whether that be a negotiated commercial solution or a determination of rights at trial.
