Whether big or small, from the city or regional, every conveyancer needs to know about strata law and regulation. This session will provide an overview of the current framework for strata law and regulation in NSW and use case studies to explore common issues which arise in practice as well as traps practitioners may fall into when faced with more unusual title situations (including company title and old easements/covenants).  Issues covered include:

  • Differences between buying and selling under strata compared to company title and when it may be preferable to retain rather than convert company title
  • Understanding the interplay when there are multiple strata plans and how to read strata plans and building management statements to avoid their misuse
  • Disputes concerning pets and what happens when the strata corporation unreasonably withholds consent
  • How to identify when there may be issues with unit entitlements and what to do if there are issues
  • What is on the horizon in terms of law reform for strata and community schemes in NSW

Elly specialises in property development including advising in relation to strata and community schemes, preparing and developing appropriate governance title and subdivision structures, acquisitions and disposals, drafting master off-the-plan sales contracts and coordinating the sales process.

Experience

Elly’s expertise includes acting for a number of major property developers to assist with residential and mixed-use development projects by advising in relation to:

  • establishment of a strata scheme or community scheme
  • conversion and termination of strata schemes
  • compliance with the strata scheme and community scheme laws
  • drafting and negotiating section 88B instruments, by-laws and management statements for both strata and community schemes
  • site due diligence and acquisitions including acquisitions of crown land and rural land
  • Foreign Investment Review Board approval and regulations
  • finance due diligence
  • drafting off-the-plan contracts and co-ordinating the sales process.

Elly also assists developers, Owners Corporations and Associations with strata and community title NCAT proceedings including proceedings relating to the reallocation of unit entitlements and waiver of initial period restrictions.
