For many clients, the focus of their estate planning starts and ends with their will. However, for many families it can be the decisions that are made prior to death (particularly once a client starts to lose capacity) that can cause the most conflict and devastation for the testator and their family relationships. An enduring power of attorney (EPA) can help minimise the risk of such disputes, but only when it is has been properly prepared – not merely tacked on or prepared as an afterthought. To assist estate planners, this session examines

  • What an EPA means for an individual client, including scope of authorisations, definition of a financial matter (how far does that extend), what is an attorney authorised to do by default, what is captured by incidental needs
  • Best practice tips for identifying and minimising the risk of elder abuse in light of recent cases and disciplinary proceedings, including who to take instructions from, verifying identity and authorisation from client, safeguards when discussing matters with other family members etc
  • Options for decision-making mechanisms, choice of attorney/s and value of processes to avoid future conflict with family
  • Enforceability issues and limitations of interstate EPAs -which jurisdictions recognise those from other states and when are separate EPAs needed for upwardly mobile clients
