The sale and purchase of land in rural areas can be a challenging exercise, particularly as not all potential issues need to be disclosed. This session will provide conveyancers with a practical checklist and advice to assist in due diligence and preparation for rural land sales and purchases, including:
- Proposed land usage: checking zoning and other restrictions
- Checking satisfactory access rights: roads, easements and rights of way including third party rights
- Chemical contamination of land and clean-up obligations
- Proposed future development or infrastructure affecting the land
- Existing third-party leases or licences such as mining and exploration, grazing, solar farms
- The effect of the Personal Property Securities Act on the purchase of farm assets
- Transfers or obtaining of permits and licences for water bores, water access, dam construction, enclosure and other activities
- Relevant laws and regulations concerning land use, native vegetation and clearing
