 Charitable Bequests: Relying on Good Drafting instead of Faith and Hope

Testamentary gifts play an important role in the ongoing success, and even existence, of many charities. Indeed, recent studies indicate that charitable bequests now account for around 20 percent of the fundraising income of Australian charities. In order to allow charities to benefit fully from the generosity of a testator and avoid unnecessary litigation or unforeseen tax liabilities, charitable gifts must be drafted carefully. This session focuses on the historical and current treatment of bequests by the courts and provides practical guidance to ensure best practice standards can be met when it comes to drafting bequests.
