The importance of the enrolment contract to the school/parent relationship cannot be underestimated, particularly during these difficult times. As a legally binding document, it needs to be reliable and thorough to cover all the bases as well as stand up under scrutiny if challenged. In this session we will health check the essential and important terms of enrolment contracts, covering:

  • Parties to the contract, and the importance of binding more than one parent
  • Incorporation of the school’s policies and procedures
  • Initial and ongoing disclosure by parents of:
  • family law court orders or significant family disruptions
  • physical, learning, health and other issues or disabilities
  • other circumstances affecting the child/family/school relationship
  • Fee payment obligations and school options for recovery
  • Termination of enrolment, in both specific and discretionary circumstances
  • Dispute resolution processes: what are the options?
  • Updating the contract: unilateral and negotiated amendments
  • Does the Unfair Contracts regime apply to enrolment contracts?

Fiona was admitted to practice in the Supreme Court of Queensland and the High Court of Australia in January 2005, and practiced in traditional law firms and Legal Aid Queensland for 15 years before leaving to undertake an “in-house” role at Hillcrest Christian College.

Fiona has appeared in the Coroners Court and the former Queensland Anti-Discrimination Tribunal, and has experience dealing with complex school law, commercial and employment law litigation. More recently, she has undertaken employment law, defamation, consumer protection, discrimination, contractual disputes, and appeals work representing schools in the Queensland Civil and Administrative Tribunal, Federal Circuit Court, Federal Court, Supreme Court and Court of Appeal including in high profile and complex multi-jurisdictional matters.

She also has extensive experience in Family Law and domestic violence matters, and has regularly appeared as a solicitor advocate in the Magistrates Courts, Federal Circuit Court and Family Court, including as Independent Children’s Lawyer. Fiona has been an accredited as an Independent Children’s Lawyer for the last 10 years, and holds accreditation as a Family Dispute Resolution Practitioner, and volunteer at Women’s Legal Service.

Fiona has served on the board of 3 not-for-profit organisations, including an Independent Church board.

Her broad experience working across a number of jurisdictions has resulted in a breadth of experience sought after by independent schools and charities
