Morning: Courtroom Tools of the Trade in Family Law

Confidence in the courtroom is a key essential for any family lawyer. The morning sessions are designed to ensure you always put your best foot forward, with sessions on family law interim hearings, utilisation of less commonly used litigation ‘tools of the trade‘, as well as the Family Court’s approach to tax liabilities.

  • Putting Your Best Foot Forward with Family Law Interim Hearings
    • Significant court delays are an unfortunate reality for family law clients, and are likely to worsen as a result of COVID-19. With parties often stuck in limbo without a resolution for years, getting the right interim decisions is now more important than ever. This session looks at how you can maximise your returns and ensure you achieve a productive outcome for your client.
  • The Family Law Litigation Tool Box
    • This session looks at some of the less commonly used ‘tools of the trade’ in family law litigation and how they can be utilized for maximum effect. With the courtroom landscape constantly changing, it is vital practitioners are across all the available weapons on their armoury.
  • Unrealised Tax Liabilities and the Family Court
    • The Family Court often ignores unrealised capital gains tax and other tax liabilities.  But does this approach result in a just and equitable outcome for the parties?   Why should one party receive tax free assets and the other party receive assets with future tax liabilities that have not been taken into account?  This session examines looks at how the Family Court’s views on tax liabilities have evolved and considers the arguments you can raise to assist with obtaining a just and equitable outcome for your clients. 

Afternoon: Difficult Parenting Matters in Family Law

Complex parenting matters often involve high emotions and high stakes. The afternoon sessions examine the key strategic and procedural issues family lawyers need to navigate, with a focus on drafting effective parenting orders, the use of secret recordings, as well as navigating relocation disputes.

  • Purpose and Persuasion: Drafting Parenting Orders that Work
    • Drafting orders for parents who cannot reach agreement and are in a state of perpetual disagreement is a daunting task. This session will explore the issues for practitioners in achieving a workable arrangement and provide practical drafting tips.
  • Secret Recordings in Parenting Matters: When Can You Press Play?
    • With the widespread use of home-recording devices, warring parties may be tempted to make secret recordings to support their case. But, when is it legal to make a recording without a person’s consent, and when will secret recordings be accepted as evidence in the Family Court?  This session examines the legality and admissibility of these types of recordings in parenting matters.
  • Relocation Disputes: Home is Where the Heart Is 
    • Relocation disputes are challenging for clients and practitioners alike. When clients seek to relocate across state or international lines, emotions can run high.  This session examines how to best navigate the process.
