ABOUT THE PROGRAM

This conference has been specifically designed to enable New South Wales lawyers to meet their CPD requirements. The substantive law topics have been carefully selected from our wide range of two-day specialist conferences and feature some of our best presenters.

  • Challenging Wills for Lack of Knowledge and Approval

    • The requirement that a testator knows and approves the contents on their will is a separate and distinct requirement for validity. It is being increasingly used as a weapon by disappointed beneficiaries where it is not possible to prove a lack of capacity or undue influence. This session examines the interplay between complex wills and alleged lack of knowledge and approval.

  • All in the Family - Complex Family Provision Claims

    • Recent case law in family provision matters highlight the complexity of modern family arrangements and the willingness of disgruntled parties to stake a claim in the deceased’s estate. This session provides a round-up of recent cases and the lessons they contain for practitioners.

  • Formation of Electronic Contracts: Binding the Parties in an Online World

    • Contracts formed online have a number of challenges for the contracting parties and for practitioners in advising clients.  Tips for avoiding the traps of online contracts are provided in this session.

  • Oppression Proceedings Under the Corporations Act - Key Legal Imperatives

    • An oppression suit can endanger a company’s very existence. It therefore pays to know how the law of oppression works and how the associated risks can be managed. This webinar examines corporate misconduct and shareholder.

  • E-conveyancing: Meeting our E-xpectations?

    • The new e-conveyancing regime commenced in mid-2018 and since July 2019 the majority of all transfer, mortgage and caveat transactions must be lodged electronically. As we edge closer towards a national electronic conveyancing system, how is the system working in practice? Are you meeting all the mandatory lodgement obligations? This session will look at the current state of play and some of the practical issues arising from this new process, as well as potential areas of concern.

  • Practice and Procedure in Conveyancing: Key Developments and Recent Updates

    • It has been a busy year for property and conveyancing practitioners with changes to the contract for the sale and purchase of land, as well as legislative reforms impacting on property law. In this session we will highlight some of the matters that you need to be aware of in your day to day practice.

  • Misleading and Deceptive Conduct in Commercial Contracts

    • It is commonplace for commercial contractual disputes to also include allegations of misleading or deceptive conduct. This session will provide an overview so that practitioners can manage risks in this area.
