ATO data show that about 10% of SMSF assets are units in unit trusts, and many of those are pre-99 unit trusts.  This presentation discusses the techniques you should use in auditing these trusts, as well as the audit risks they pose, including: 
  • Audit risks with unit trust investments generally
  • Audit evidence required when auditing unit trust investments
  • Audit of reinvestments up to 30 June 2009 – do they comply?
  • Audit of activities of trusts after 30 June 2009:
    • annual distributions – are they being made?
    • acquisition of additional property
  • Auditing transfer from a unit trust to a Division 13.3A entity
  • Auditing Div 13.3A entities – key issues:
    • auditing arms length requirements– how to do it
    • auditing lease arrangements – formal lease agreement, lease payments set at market value
    • interest rates on loans by unit holders
  • Unrelated unit trusts – issues in auditing whether they are unrelated:
    • read the deed to determine if the fund controls the trust
    • being sure that control does not occur indirectly (Part 8 Associates)
  • Unit trust investments and the sole purpose test: what are the real motives for the structure?
